Clinical negligence (sometimes called medical negligence or medical accident) is where avoidable harm has been caused as a result of treatment or failure to treat appropriately. The law of clinical negligence facilitates disputes between patients and health care providers to be resolved either by negotiation or through the courts.
A claimant will be required to demonstrate that whatever the healthcare worker did (or did not do) fell below the standard of a reasonably competent professional in that area of medicine, by showing that other professionals would have acted in a comparable manner. A judge would then hear evidence from experts and decide whether the actions taken were appropriate.
