Criminal Law is law which involves the state (or The Crown, sometimes referred to as Regina) bringing a prosecution against an individual. Only crimes which already exist in law can be used to prosecute people. These are laid down by Parliamentary Law, or by previous decided case history in the courts (common law).

This country has a criminal justice system through which action is taken to deal with those suspected of committing offences. The criminal justice system refers to the whole process from the initial investigation of a crime through to acquittal or to conviction and sentence in the criminal courts.

There are two levels of criminal courts: the first is the Magistrates Court which deals with less serious crimes such as motoring offences, and petty theft. These courts can still give out prison sentences. There are no juries and cases are decided by a District Judge or Lay Magistrate. More serious cases go to Crown Courts where there is a jury. More serious cases include murder, manslaughter, rape and other sexual offences, serious assault, fraud, and terrorism.
