This area of law concerns disputes involving injury to a person as a result of someone else's negligence. A personal injury occurs when a person has suffered some form of injury, either physical or psychological, as the result of an accident or medical misconduct (see also clinical/medical negligence - www.legallybetter.com/review/clinneg.aspx). The case will settle either through negotiation or by the courts.
Common types of personal injury claims are; accidents at work, road traffic accidents, tripping accidents, holiday accidents and defective product accidents. The term personal injury also includes industrial disease cases.
Where the accident was the fault of someone else, the injured party may be entitled to monetary compensation from the person whose negligent conduct caused the injury. As a guide, court proceedings must be commenced within 3 years of the date of the accident.
Legal Aid for personal injury claims was withdrawn in the late 1990s and replaced with 'no win, no fee' arrangements whereby a claimant would not be charged a fee by their lawyer if their case was not successful.
